Litigation, mediation and arbitration

We handle commercial and civil cases, and we assess every one of them before a claim is filed. Our team includes an attorney-at-law who completed judicial training and passed the Polish judicial qualifying examination (egzamin sędziowski).

Courtroom interior — litigation and arbitration

How we help

Assessing the risk before a dispute

We analyse the case file, the evidence the party will have at its disposal and the applicable law, and then we tell you plainly: what your chances are, where the weak points lie, how long the proceedings may take and what costs you need to allow for. Sometimes the best way out is a settlement – and its terms need to be negotiated well.

Demand letters, negotiations and settlements

We prepare pre-action payment demands and replies to demands, negotiate on behalf of clients and draft settlements that can be enforced.

Representation before the courts

We conduct cases before the common courts in commercial and civil proceedings. We draft statements of claim, statements of defence, appeals, objections to payment orders, interlocutory appeals, complaints and cassation appeals to the Supreme Court.

Arbitration

We represent parties before permanent arbitration courts and in ad hoc arbitration. We also advise on drafting arbitration clauses in contracts, before any dispute arises.

Mediation

We prepare clients for mediation and take part in it as their representatives where this is in the client’s interest.

Interim relief and enforcement

At every stage of the proceedings we apply for security for claims, for example by attaching bank account receivables or establishing a compulsory mortgage. We also file for enforcement and monitor its progress on an ongoing basis.

Who we work for

  • Entrepreneurs, companies and company bodies.
  • Communities of unit owners (wspólnoty mieszkaniowe), cooperatives, associations and foundations.
  • Private individuals and investors.
  • Clients from Poland and abroad – we work with entities from several countries and with law firms in other jurisdictions.

How a dispute is conducted

  1. Analysis of the case and a written assessment of the chances, costs and risks.
  2. An attempt at an amicable solution: a demand letter, negotiations or mediation.
  3. Where needed, an application for security for the claim.
  4. A statement of claim or defence and conduct of the proceedings.
  5. Where needed, an appeal and, once the case is won, enforcement.

Frequently asked questions

Before you call us

That depends on the evidence, the amount in dispute, the costs and time involved, and on whether the other side is solvent. After reviewing the documents we present our assessment and recommendation, but the decision is yours.

The parties have to agree to arbitration, usually in a clause in their contract. The proceedings are confidential, the parties have a say in the choice of arbitrators, and there is generally only one level of adjudication.

It is temporary protection for the duration of the proceedings, such as attachment of a bank account or a prohibition on disposing of a property. The court grants it when the claim is shown to be plausible and enforcement of a future judgment would otherwise be at risk.

It varies widely – it depends on the course of the proceedings and the complexity of the case.
